He didn't say that he got a C&D, he said that he was concerned that he might eventually get one if the game got exposure, so wasn't keen on putting the effort into it.

The Distrib menu simply packages together a few platform-specific files into a .zip or other archive. It supports Windows, Debian Linux and OS X; so you might want to use it to create an OS X app as well. I don't think that creating a Windows installer adds much over using simple zip containing an .exe file.
Note that if you want to create an Android or Ouya package you would have to get James to do so anyway.
